1. FOR USE OF THIS WEBSITE
This agreement in the context of this website is a contract between “you” means you, the user or customer of this website and "we", "our" and "us" means First Shopping Group Pty Ltd ABN 42 167 956 354. These terms apply to the ordering, purchase and delivery of products from firstshopping.com.au and form a contract between you and First Shopping Online as amended from time to time. If you use this website you agree to be bound by the Terms and Conditions and if you shop at this website you agree to the terms of the Contract of Sale, these Terms and Conditions, any applicable law or regulation and/or generally accepted practices or guidelines
You will be bound by these Terms when you submit an order via the website.  Each Order you place will be a separate contract between you and First Shopping Online for the supply of Goods, under these Terms. 


2. CHANGES TO PRODUCTS
We and any other persons involved in the management of this website may make changes to the products described, and to other content of this website, at any time without notice. You should check products information regularly for such changes. We make every effort to ensure that product descriptions on our website are accurate. However some inaccuracies, typographical errors or misinterpretations may occur.


3. PRODUCT PRICES & PAYMENT
For each Order, we will charge you and you agree to pay:
(a) The Price (which is the Price at the time the Order is submitted); and
(b) The Delivery Fee.
The price displayed for products on this website does not include postage/delivery charges which will depend on the destination and other factors. We always seek to the most competitive prices of the products. Prices, promotions, versions and availability advertised are subject to change without prior notice and we therefore reserve the right to change prices displayed on our website at any time.
Unless otherwise stated, all prices quoted are in Australian Dollars and where applicable, inclusive of goods and services tax (GST). GST does not apply to the purchase of Gift Cards. Any fees and charges (e.g. Delivery Fees) imposed by these Terms also include GST where applicable. 
We only accept payment through BPAY, PayPal and Credit cards (Visa and Master) and will be subject to any terms and conditions of these providers.
Payment will not be processed until we have received all relevant information required for processing to be completed.
The processing of payment for Orders placed on a weekend or a Public holiday will not begin until the next working day.
You will receive an order confirmation by email once payment has been processed.


4. ORDERS FOR PRODUCTS
1) An Order submitted by you is an offer by you to purchase products for the Price (plus any Delivery Fee) as specified at the time you submit your Order.
2)  In completing the Order, you agree to provide complete and accurate personal details (or those of the recipient of gifts) to enable the processing and delivery of your Order. This information will also be used by the Delivery Courier to deliver your Order. 
3) Once you submit your order, cancellations of your Order or changes to the products in your Order cannot be made. However, you can return products under the Returns Policy. You should check your Order carefully before submitting your Order. 
4) You acknowledge that all Orders are for products intended for personal and non-commercial use only. 
5) First Shopping reserves the right to accept or reject your Order for any reason at any time. If we reject an order, we will notify you of the reasons for rejection via email within 5 Business Days. 
6) First Shopping will not be liable to you for your loss or that of any third party for the rejection of an Order.
7) You acknowledge and agree that: you have read any written description of the products on the Website before submitting your Order.


5. AVAILABILITY OF PRODUCTS
From time to time, some products on the website may be out of stock or unavailable and we may not be able to fulfil all or part of your Order.  If this happens, First Shopping will use reasonable efforts to either:
1) source the products; or
2) contact you within 5 Business Days to either:
      (i) Arrange a full or partial refund; or
      (ii) Change your Order to replace the product with a comparable product in a similar price range (where available) as agreed with you; or
      (iii) Come to an alternative arrangement.
Where a comparable product or alternative arrangement cannot be agreed, we will refund you the price paid for the products. We may withdraw or suspend from sale any product displayed on the Website, either temporarily or permanently, at any time. 
All pictures and images of products displayed on the Website and any accessory featured with the products are for illustrative purposes only.  The accessory may be sold separately and the price of a particular product may not include the accessory. The sizes, dimensions and colours of products may vary slightly or differ in real life. 


6. SUPPLY AND DELIVERY
You will be provided with an estimated delivery time when you checkout from placing your order. Normal delivery is within 2 to 10 working days from the date of payment of your order. We will make every effort to deliver your product within the estimated delivery time but the actual delivery time may vary due to changes in supply or circumstances beyond our control.
First Shopping uses Delivery couriers to deliver your products. You agree that your details, including your Delivery Address, will be supplied to the Delivery courier for the purpose of delivering your products. You can track delivery status online.

Shipping to P.O. BOX address is NOT available, please provide a non P.O. BOX address for delivery purpose. 
If you unable to receive your package within the estimated period (please exlc weekends and public holidays), please contact our customer services team at service@firstshopping.net.au 


7.  WARRANTY
First Shopping provides a voluntary warranty and applies the Conditions and Warranties required by law.
Any refund agreed to may be less than the purchase price depending on any use or consumption of the product which has occurred or any contribution that use by you has made to the cause of the claim.
Customer Service will consider each claim on its merits on a case by case basis and, if required, will negotiate a solution that is acceptable to First Shopping and you including any costs involved.
If the product is damaged during delivery and a claim is made within 14 days from the date of dispatch, First Shopping will replace or repair the product at our discretion and our cost. If First Shopping has no further stock of the item and it cannot be repaired First Shopping will replace it with a similar product or offer you a full refund. 
If the damage is discovered outside the 14 day period contact Customer Service who will determine whether circumstances are such that you can still proceed with a claim. This warranty does not apply to damage packaging only 
Many of the products supplied by First Shopping are covered by a Manufacturers voluntary warranty. The terms and conditions of such warranties are beyond our control and it is your choice whether to use such warranties. For some products it may be more efficient for you to contact the manufacturer rather than First Shopping. 


8. RETURN POLICY
We know it can sometimes be hard to choose the right items online and we want to make sure you're completely happy with your purchasing experience with First Shopping. So we've made the process of returning anything that's 'not quite right' as easy as possible. You can choose to return or exchange your item within 30 days 
We simply ask that:
· Items are unworn and unused (with the original tags and hygiene seals intact)
· Items are in the original packaging (which needs to be in original condition)
· You retain your receipt for proof of purchase
Essentially – we still need to be able to sell it to a good home where it will be loved (seems only fair!). So we suggest you try on any items you might not be sure about with their tags etc. still attached. Please note that we do have a list of excluded merchandise that we cannot accept change of mind returns on. 



9. MAKING A CLAIM
9.1 Provide us with a copy of your tax invoice or similar proof that the item was purchased from us.
9.2 Describe accurately the problem you have encountered and provide evidence (eg a photograph) to support your claim
9.3 State whether you are requesting a replacement, repair or refund.
